Fancy Monkey expressly disclaims all warranties, including but not limited to:

•      Implied warranties of merchantability and fitness for a particular purpose

•      Warranties that the Site will be uninterrupted, error-free, or free of viruses or other harmful components

•      Warranties regarding the accuracy, completeness, or reliability of any content on the Site

•      Any warranty that product descriptions, nutritional information, ingredient lists, or allergen information displayed on this Site reflect the current product formulation. The physical product label is the controlling and most current source of this information.

TO THE FULLEST EXTENT PERMITTED BY LAW, FANCY MONKEY, ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

•      Your use of, or inability to use, this Site or its content or of any Fancy Monkey products

•      Any errors or omissions in content

•      Unauthorized access to or alteration of your data

•      Any other matter relating to this Site or our products and services

Our total liability to you for any claim arising out of or relating to these terms or your use of the Site shall not exceed the amount you paid to us in the six (6) months preceding the claim.

ANY CAUSE OF ACTION OR CLAIM ARISING OUT OF OR RELATING TO THIS LEGAL NOTICE, THIS SITE, OR YOUR USE OF FANCY MONKEY LLC PRODUCTS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Notwithstanding the foregoing, nothing in this Section limits Fancy Monkey's liability for (a) death or personal injury caused by Fancy Monkey's gross negligence or willful misconduct, or (b) any liability that cannot be excluded or limited under applicable law.

We strive to ensure that all product descriptions, pricing, and other information on this Site are accurate. However, we do not warrant that product descriptions or other content are error-free, complete, or current. Prices are subject to change without notice.

In the event a product is listed at an incorrect price due to a typographical error or error in pricing information, we reserve the right to:

The physical product packaging label is the controlling and most current source of ingredient and allergen information. Online product descriptions may not reflect the most recent formulation. It is your responsibility to read the product label before consuming any Fancy Monkey LLC product. 8. Governing Law & Jurisdiction

This Legal Notice and any disputes arising from your use of this Site or purchase of our products shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any legal action or proceeding arising under this Legal Notice shall be brought exclusively in the federal or state courts located in Boulder, Colorado, and you hereby consent to personal jurisdiction and venue in those courts.

9. Dispute Resolution

Step 1 — Talk to us first.
We'd genuinely rather just fix it. If you have a concern or dispute, reach out to our customer service team at hello@meetfancymonkey.com before taking any formal action. Most issues get resolved quickly this way.

If you submit a written description of your dispute to hello@meetfancymonkey.com, both parties agree to make a good faith effort to resolve it informally for a period of thirty (30) days from the date we receive it (the "Informal Resolution Period"). Neither party may initiate arbitration until the Informal Resolution Period has expired without resolution. This requirement does not apply to claims seeking emergency injunctive or equitable relief.

Step 2 — Binding Arbitration.
If your dispute is not resolved during the Informal Resolution Period, any dispute, claim, or controversy arising out of or relating to this Site, these terms, or any Fancy Monkey LLC product shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Boulder, Colorado, or via telephone or video conference at your election. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Arbitration Costs.
Fancy Monkey LLC will pay all AAA filing fees, case management fees, and arbitrator compensation for any consumer arbitration claim where the amount in dispute is $75,000 or less. If your claim exceeds $75,000, AAA fee allocation will be governed by the AAA Consumer Arbitration Rules. You are responsible for your own attorneys' fees unless the arbitrator determines that your claim was filed in bad faith or for an improper purpose, in which case the arbitrator may award fees against you.

Class Action Waiver.
To the extent permitted by law, you agree to resolve any dispute with Fancy Monkey LLC on an individual basis only. You waive any right to bring or participate in any class action lawsuit, class-wide arbitration, consolidated proceeding, or private attorney general action against Fancy Monkey LLC This waiver applies to all claims, including but not limited to claims arising from food safety, allergen labeling, product quality, ingredient accuracy, or marketing representations. If a court finds this class action waiver unenforceable as to a particular claim, that claim shall proceed in court rather than arbitration, and all other claims shall remain subject to arbitration on an individual basis.

Your Right to Opt Out.
You may opt out of the arbitration agreement in this Section 8 by sending written notice to hello@meetfancymonkey.com with the subject line "Arbitration Opt-Out" within thirty (30) days of the date you first agree to this Legal Notice or the Fancy Monkey LLC Terms of Service, whichever is earlier. Your opt-out notice must include your name, the email address associated with your account or purchase, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other provision of this Legal Notice or the Terms of Service. If you do not opt out within the 30-day window, you will be bound by this arbitration agreement.

10. Indemnification

You agree to defend, indemnify, and hold harmless Fancy Monkey and its owners, officers, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with and including any claims arising from your misrepresentation of allergen restrictions or dietary requirements when placing an order:

•      Your access to or use of the Site

•      Your violation of these terms

•      Your violation of any third-party rights

•      Any content you submit, post, or transmit through the Site

11. Privacy

This Site is intended for use by adults (18 years of age or older). Fancy Monkey LLC does not knowingly collect personal information from children under the age of 13.
